Official contest rules (“Contest rules”)
The Beer Store Broil King Good Citizen Contest (“Contest”) is sponsored and administrated by The Beer Store, 12258 Coleraine Drive, Bolton, ON L7E 3A9 (the “Sponsor”). All inquiries should be directed to the Sponsor.
The Contest will begin 5:00 p.m. EDT on May 22nd, 2020 and end at 11:59 p.m. EDT on June 28th, 2020 (the “Contest Period”).
TThe Draw Date for the grand prize and secondary prizes will be July 10th 2020. Draw dates for the weekly prizing will be June 1st, June 8th, June 15th, and June 22nd, June 29th 2020. (the “Draw Date”).
To enter the Contest and be eligible to win, an individual must: (i) be legal residents of Ontario; (ii) have reached the age of 19 years old or older at the time of entry; and (iii) complete contest entry instructions set out in section 5 – How to Enter
Specifically excluded from entering the Contest are: (a) employees, officers, directors, agents, representatives, and advertising and promotional agencies of the Sponsor and Broil King, Onward Manufacturing Company Ltd. (the “Prizing Provider”), and its respective subsidiaries and affiliates, as applicable; and (b) any immediate family members (regardless of where they live) of a person excluded under (a) or persons with whom a person excluded under (a) is domiciled (whether related to that person or not). In these Contest Rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partners or spouse.
Content must not be defamatory, trade libellous, pornographic or obscene, and must not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; conduct or other activities in violation of these Contest Rules; and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.
The Sponsor will initially screen every nomination story. Any nomination story that the Sponsor deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Contest Rules will not be considered and will be forfeited from contest eligibility
For greater certainty, the Sponsor reserves the right, in its sole and absolute discretion and at any time, to modify, edit or remove any nomination story, or to request an entrant to modify or edit his or her nomination story, if a complaint is received with respect to the story, or for any other reason.
No purchase necessary. To enter the Contest, visit https://www.124daysofsummer.ca and follow the instructions to complete and submit an official entry form by entering your first name, last name, mailing address, telephone number, email address, and the name of the individual you would like to nominate. The individual you choose to nominate must fit the criteria as stated in the above website link and you must provide a detailed account/story of why the nominee should win the contest based on the good deed that they have done in at least 200 characters. The nominee that is selected by the eligible entrant must be 19 years of age or older at the time of nomination and must be a legal resident of Ontario, Canada. All entries must be received within the Contest Period to be valid. Entries generated by script, macro or other automated means and entries by any means which subvert the entry process are void. By entering the contest, each entrant agrees to abide by these contest rules & regulations (“Contest Rules“)
No other method of entry is accepted.
Limit one (1) entry per person per day during the Contest Period.
There is one (1) grand prize (the “Grand Prize”) available to be won which consists of:
i. One (1) Broil King Imperial XLS Barbecue (approximate retail prize value: $3,000.00 CAD)
ii. A selection of Broil King accessories (approximate retail prize value $250.00 CAD) The total approximate retail prize value of the Grand Prize is $3,250.00 CAD.
There are two (2) secondary prizes (each, a “Secondary Prize”). The secondary prizes consist of: Secondary Prizing: Two (2) prize packs
One (1) Broil King® Pellet 500 (value $1,850.00 CAD) a. A selection of Broil King® accessories (approximate retail prize value $150.00 CAD)
One (1) Broil King® Baron 490 Pro IR + accessories (approximate retail prize value $1,350.00)
The total approximate retail prize value of all Secondary Prizes is $3,350.00 CAD.
There are five (5) weekly prizes (each, a “Weekly Prize”) available to be won which each consist of:
i. A selection of Broil King accessories (approximate retail prize value $180.00 CAD) a. One (1) Beer Store Gift Card with a retail value of $300.00 CAD. Weekly prizing of Beer Store gift cards shall be issued under the compliance of The Beer Store’s Gift Card Terms and Conditions which can be found at the following URL: Gift Cards
ii. The total approximate value of all Weekly Prizes is $2400.00 CAD
Unless otherwise specified, the Grand Prize, Secondary Prize, and Weekly Prize shall be collectively referred to as (“Prize”) for the remainder of the Contest Rules.
Without limiting the generality of the foregoing, the following terms and conditions apply to the Prize:
i. The Prize must be accepted as awarded and is not transferable, assignable and/or or convertible to cash; No substitutions except at Sponsor’s option;
ii. Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a Prize or prize component(s) of equal or greater value
iii. By accepting the Prize, the confirmed winner agrees to waive all recourse against the Releasees if the Prize or a component thereof does not prove satisfactory, either in whole or in part;
iv. Any difference between the market value of the Prize and its stated approximate retail value will not be awarded;
v. All characteristics and features of the Prize (and of each Prize element), except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion.
vi. Each Prize will only be awarded to the Nominee chosen by the Eligible Entrant. For certainty, the Eligible Entrant who enters the contest is not eligible to win the Prize. The Nominee is the only person allowed to collect the Prize.
vii. There is a limit of one (1) Prize per person.
At the end of the Contest Period, a draw will be held for the Grand and Secondary prizes. Three (3) Entrants will be selected by the Sponsor from all eligible Entries received during the Contest Period (“Selected Entrant” or “Selected Entrants”). The Selected Entrants’ nomination story will be judged and scored for by a panel of judges based on a specific set of criteria. The criteria to be used for judging and their relative weight will be as follows: community involvement: 40%; social impact of deed: 35%; quality of writing: 25%. The Grand Prize and Secondary Prize winners will be determined by July 10th. In the event of a tie, the Entrant with the highest score for community involvement will be declared the winner. The most highly voted Entrant nomination will be deemed the Grand Prize winner. Entrants whose nominations received the second and third highest scores will be deemed the Secondary Prize Winners.
The selected entrants will also be judged on the following criteria:
i. Minimum nomination entry character length of 200 characters
The contest for the Grand Prize and the Secondary Prize is a consumer generated contest in which the Sponsor will select the best nomination story based on the provided contest criteria.
Sponsor will contact the Selected Entrants by the e-mail and/or phone number provided in their Entry before 5:00 p.m. EST on July 10th. Selected Entrants will have seven (7) days to: (i) Provide the contact information of the nominee. Once the nominee has been contacted and informed of winning the Prize, the winning nominee will have seven (7) days to: (ii) sign and return to Sponsor a Declaration and Release that contains, but not limited to (a) an acceptance of prize (b) a release of Sponsor from liability and (c) an acknowledgment of compliance with the Contest Rules. Upon satisfying such eligibility requirements during the prescribed time periods, the Nominee will be awarded the Prizes.
On the Weekly Prize draw dates (June 1st, June 8th, June 15th, and June 22nd, June 29th 2020), one (1) Entrant will be selected by the Sponsor from a random drawing from all eligible Entries received during the Contest Period.
Sponsor will contact the Selected Entrants for the Weekly Prize Draws by the e-mail and/or phone number provided in their Entry within 48 hours of drawing said Selected Entrant. Selected Entrants will have seven (7) days to: (i) provide the contact information of the nominee. Once the nominee has been contacted and informed of winning the Prize, the winning nominee will have seven (7) days to: (ii) sign and return to Sponsor a Declaration and Release that contains, but not limited to (a) an acceptance of prize (b) a release of Sponsor from liability and (c) an acknowledgment of compliance with the Contest Rules; and (ii) correctly answer a mathematical skill-testing question. Upon satisfying such eligibility requirements during the prescribed time periods, the Selected Entrants will be awarded the Prizes.
In the event a Selected Entrant/Nominee is found to be ineligible, or if he/she cannot or does not comply with these Contest Rules, the Selected Entrant/Nominee may be disqualified and an alternate winner may be selected. To the extent applicable, if the Selected Entrant/Nominee fails to respond within the prescribed time, such will result in disqualification. Sponsors are not responsible for communication problems of any kind. Sponsors are under no obligation to select an alternate winner.
The odds of winning the Grand and Secondary prizes depend on receiving the highest score against the entry criteria as determined by the panel of judges.
The odds of winning the Weekly prizes depend on the number of eligible Entries received during the Contest Period.
All Entries are subject to verification. Sponsor may require Entrant/Nominee provide proof of identity and legal age.
Proof of submission does not constitute proof of receipt. All Entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the Contest Rules may be disqualified by the Sponsor. Sponsor takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed Entries, typographical or other production errors, or any errors or omissions in printing or advertising related to this Contest.
If the identity of an Entrant is disputed, the authorized account holder associated with the e-mail address or cell phone number (as decided by Sponsor) of the Entry, during the Contest Period, will be deemed to be the Entrant. An Entrant may be required to provide proof that he/she is the authorized account holder associated with the Entry.
Any attempt by any Entrant, to obtain more than the stated maximum number of Entries by using multiple/different names, email addresses, accounts, identities, registrations and logins, or any other methods, or has entered or participated in any fashion not sanctioned by these Contest Rules will void that individual’s Entry and eligibility to win the Prize and that individual will be disqualified from the Contest and, at the sole discretion of the Sponsors, any of the Sponsors’ other promotions.
By entering the Contest, Entrant/Nominee agree to forever release, discharge and hold harmless The Beer Store, and its parent, related or affiliated companies, affiliates, subsidiaries, their advertising and promotional agencies and their respective officers, directors, employees, partners, representatives, successors, assigns and agents (the “Releasees”), from any and all damages, injuries, death, loss, or liability to person or property, due in whole or in part, whether directly or indirectly, without limiting, by (a) entering and participating in the Contest, including any part related to the Contest and (b) the acceptance, possession, participation, use or misuse of the Prize, including travel to and from any Contest-related activity. By participating, Entrants agree to be bound by these Contest Rules, including all eligibility requirements, and to the decisions of the Sponsor, whose decisions are final and binding in all respects. Failure to comply with these Contest Rules may result in disqualification from the Contest
If an Entrant/Nominee wins a Prize and accepts the Prize, such acceptance shall mean full satisfaction of the entitlement as an Entrant and as a winner in the Contest and the Entrant/Nominee fully discharges and forever releases the Releasees, of and from any and all claims, demands, losses, damages, actions or causes of action whatsoever, whether known or unknown, whether at law or in equity which they or their heirs, executors, administrators, successors or assigns may now or hereafter have against any of the Releasees in connection with the Prizes.
The Entrant/Nominee also acknowledges, without limiting the generality of the foregoing, that the Releasees will not be responsible for any injury, accident, death or dismemberment, or any other loss, damage or expense in connection with the participation in the Prize. The Entrant/Nominee also acknowledges that none of the Releasees has offered any warranty or guarantee respecting the Prizes. Further, the Entrant/Nominee assumes all responsibility and liability for any loss, injury or damage to any persons or property, which results from the Entrants actions or omissions, whether negligent or otherwise, in connection with the Prizes.
The Sponsors accepts no responsibility for loss, damage or claims caused by or resulting from the Contest or acceptance of the Prize. The Sponsors will not be responsible for late, lost, illegible, incomplete, falsified or destroyed Entries and all such Entries are void. Entries that have been falsified, tampered with or altered are void. The Sponsors does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof.
The Sponsors will not be responsible for mail, telephone, technical, network, online, electronic, computer hardware or software interruptions or failures of any kind, misdirected, stolen, incomplete, incomprehensible or delayed Internet/e-mail computer transmissions on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to a participant’s or any other person’s computer relating to or resulting from visiting, participating or downloading any materials related to this Contest.
The Sponsors extends absolutely no representations or warranties in respect of any Prizes and accepts no liability arising in respect of such Prizes or in the use thereof.
The Sponsors reserve the right to terminate or suspend this Contest or to amend the Contest Rules at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including without limitation by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes, the Sponsors reserves the right to cancel, terminate, modify or suspend the Contest, including without limitation the cancellation of any method of entry or the extension or modification of the Contest start and end dates. In such circumstances, the Sponsors reserves the right to randomly select a winner from previously received eligible Entries by the end of the Contest Period. The Sponsors shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest.
The invalidity or unenforceability of any provision of these Contest Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable, these Contest Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
Any attempt by any individual, whether or not an Entrant, to damage, destroy, tamper or vandalize the website, survey or otherwise interfere with the operation of this Contest, is a violation of criminal and civil law and the Sponsors reserve the right to seek damages and diligently pursue all remedies in this regard against any offending individual or entity to the fullest extent permissible by law.
This Contest is subject to federal, provincial/territorial and municipal laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, or the rights and obligations of Entrants and the Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario in Canada, as applicable, without giving effect to its conflict of law, rules, and provisions. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial/territorial and municipal laws or the policy of any other entity having jurisdiction over the Sponsors.
Prizes may be subject to statutory tax withholding and remittance obligations under applicable law. All federal, provincial, local, and other taxes on the Prize, if any, are the sole responsibility of the Winner.
The Beer Store and Brewers’ Distributor Ltd. respect your privacy. Personal information collected from Entrants will only be used by the Sponsors to administer this Contest. Information collected by surveys will be used to better understand our client needs and help us enhance our products and services. By participating in this Contest, each Entrant consents to the use of his/her name, address (city and province), likeness, biographical information, photograph, video recording, voice, statements and Entry information, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsors, for advertising and/or publicity purposes in any and all media (now or hereafter known) throughout the world, in perpetuity without compensation, notification, or permission, unless otherwise prohibited by law.
