Terms & Conditions

These terms and conditions (“Terms”) govern your access and use of the website located at https://dropandgo.thebeerstore.ca/ (“Site”), and the services provided by Brewers Retail Inc. o/a The Beer Store (“TBS”) within the Site including the Drop & Go Program (“Program”).
1. Definitions
“Account” means the Customer’s online account registered on www.thebeerstore.ca website.
“Applicable Law” means any domestic or foreign statute, law, ordinance, rules, regulation, treaty, or regulatory policy, guideline, code, by-law or order that applies in whole or part to the applicable situation or event.
“Bag or Bags” means a clear bag used to fill Eligible Containers to return to select TBS Stores participating in the Program.
“Business Hours” means the operating hours in which TBS Stores participating in the Program are open to the general public and may vary from location to location and is subject to change without notice.
“Customer” means any person who registers for the Program by creating an online account at www.thebeerstore.ca and uses the Program.
“Eligible Containers” means beverage alcohol containers specifically aluminum cans that qualify for a refundable deposit and were purchased in the Province of Ontario. Eligible Containers consists of cans less than or equal to 1 litre subject to a 10-cent deposit. Note: Non-Program cans found during processing are not paid out and are excluded from the deposit refund calculation, but are retained for recycling.
“Tag Printing Kiosk” means the self-use kiosk computers at TBS Stores for processing Program Bags.
“TBS Stores” means participating TBS retail locations in the Program and may be subject to change from time to time without notice.
2. PROGRAM DESCRIPTION
The Program allows Customers to place Eligible Containers into authorized Bags and drop off those Bags at participating TBS Stores for processing and payment of eligible refundable deposits. Customer is required to create an Account and log into the Site where they will be prompted to enter the quantity and size of the Eligible Containers, they wish to return to TBS. The Program is intended solely as a convenience service. All Bags and container counts are subject to verification, inspection, and reconciliation by TBS.
3. PROGRAM ELIGIBILITY
To participate in the Program, Customers must:
Be at least nineteen (19) years of age;
Complete Account registration at www.thebeerstore.ca;
Provide accurate, valid and current information as required;
Acknowledge and agree to these Terms.
TBS reserves the right to refuse, suspend, or terminate participation in the Program for any reason as permitted under Applicable Law.
4. REGISTRATION AND ACCOUNT RESPONSIBILTIES
Customers are responsible for:
Maintaining accurate and valid Account information;
Safeguarding login credentials;
Promptly updating contact and payment information;
All activity occurring under their Account.
TBS may require identity verification before creating or maintaining an Account.
5. BAG PREPARATION REQUIREMENTS
Customers must:
Use only authorized Bags;
Properly secure Bags before drop-off;
Ensure Eligible Containers are empty of liquid;
Count Eligible Containers accurately and enter the declared amount in the Site;
Visit a participating TBS Store and print off the bar code associated with your Bag using the Tag Printing Kiosk and attached the bar code sticker to your Bag. One bar-code per Bag;
Drop off Bag at the TBS Store counter or designated front of store drop area to scan the bar code affixed to the applicable Bag in order to ensure processing.
TBS may refuse Bags that:
Contain prohibited items;
Create health and safety risks;
Are damaged or improperly sealed;
Contain excessive contamination.
6. ELIGIBLE CONTAINER ACCEPTANCE CRITERIA
Only Eligible Containers as defined herein under applicable deposit return programs in the Province of Ontario are accepted by TBS.
Use of the Program to return Eligible Containers is permitted only if:
Contents are Eligible Containers, in a clear bag with one barcode per Bag;
No visible contamination;
Bag is labelled with barcode sticker printed from the Tag Printing Kiosk and tied to the Customer’s count entry submitted through the Site;
Maximum of 500 cans per Bag/transaction. Customers with larger returns must use multiple labelled Bags or the standard assisted return process which is to return your containers at the designated empty return counter at TBS stores where a TBS employee will verify and pay out deposits as applicable.
TBS may reject processing containers if they:
Are not recognized as deposit-bearing containers;
Are damaged beyond identification;
Are counterfeit or altered;
Do not qualify under Applicable Law or Program requirements.
For greater certainty, TBS reserves the right in its sole discretion to determine container eligibility pursuant to the Program and all decisions shall be final unless otherwise communicated by TBS.
7. PROHIBITED MATERIALS
Customers must not place any of the following materials in the Bag subject to the Program:
Garbage or household waste;
Hazardous materials;
Sharps or medical waste;
Chemicals or flammable materials;
Food waste;
Glass;
Containers containing liquids;
Any item not specifically accepted by the Program.
TBS reserves the right to suspend and/or terminate Accounts where the Customer does not adhere to the Terms herein.
8. TRANSFER OF OWNERSHIP
Upon acceptance of a Bag at a participating TBS Store, ownership of the Bag’s contents transfers to TBS in accordance with TBS’ Deposit Return Program and the Ontario Deposit Return Program (ODRP) as applicable subject to the limitations in the Terms stated herein.
9. PROCESSING AND VERIFICATION
Customer acknowledges and agrees that:
Container counts submitted through the Site are considered estimates until processing is completed by TBS;
Final container counts are determined by TBS’ processing systems, policies and procedures;
TBS may use manual counting and/or automated counting processes to validate the Customer’s container count.
Processing times may vary.
10. PAYMENT METHODS AND PAYMENT OF REFUND DEPOSITS
Deposit refund payments shall be based solely on Eligible Containers successfully verified during processing.
Payments shall be made as follows:
Electronic Funds Transfer (EFT) to the registered email account on file in Customer’s account.
Customer Account payouts are capped at $2,500.00. If the Customer’s Account reaches a balance of $2,500.00, the Site system shall automatically issue an EFT to the registered email address on file with the Customer and will pay out the entire balance of $2,500.00 to the Customer.
Customers acknowledge and agree that the minimum payment amount for any deposit balance maintained within the Site shall be twenty-five dollars ($25.00). Deposit balances below $25.00 shall not be disbursed and shall be carried forward until the accumulated balance equals or exceeds $25.00, at which time payment may be issued in accordance with the Terms stated herein.
In order to use the Program, Customer will be required to enter their email address for a designated account in order to be paid via EFT the deposit refund owed. The email account and Account holder must be one and the same person. In order to process payment through the Site, your financial institution’s information will be collected by our third party payment processor (“Payment Processor”); however, the Payment Processor will only complete and process your funds transfer once you select the option to be paid out your deposit refund or you reach the cap of $2,500.00
11. PROCESSING ERRORS AND DISPUTES
If a Customer believes an error has occurred regarding the reported container count, the Customer must notify TBS within twenty (20) days of the verified count date.
12. ABANDONED ACCOUNTS AND UNCLAIMED FUNDS
Unclaimed deposit funds will be handled in accordance with Applicable Laws. TBS reserves the right to designate an Account as inactive and to close such Account where no Account Activity has occurred for a continuous period of two (2) years, subject to any requirements under Applicable Laws. For the purposes of this section, “Account Activity” includes any customer-initiated action in respect of the Account, including, without limitation, a Bag drop, login to the Site, submission of a payout request, or any other action that demonstrates ongoing customer engagement with the Account.
13. PROGRAM CHANGES
TBS may modify, suspend or discontinue the Program at any time, without prior notice. Updated Program terms will be posted on the Site and become effective on the date specified. TBS reserves the right to revise these Terms concerning your future use of the Site and the services provided through the Site at any time and for any reason, without notice or obligation, to you. Customer acknowledges and agrees, that where the Terms have been updated, the Customer’s continued participation after such changes become effective constitutes acceptance of the revised Terms.
14. AGREEMENT TO TERMS
Your use of the Site may not be available or permitted for disclosure and use in all jurisdictions, and shall only constitute an “offer or solicitation” where permitted, and only to the extent permitted, by Applicable Law. The Site shall not be used where, and to any extent, such use is prohibited by Applicable Law. Your use of the Site from any location is subject to your compliance with all Applicable Laws that may be applicable to you. You agree, and confirm, that your use of the Site is in full compliance with the laws of the jurisdiction(s) to which you are subject, and that you are not prohibited from using the Site due to any restriction, including any age restriction.
15. ENTRY AT YOUR OWN RISK
By entering and/or using the Site and using the services provided, you acknowledge and agree that your use is at your own risk and that the Site, TBS, its owners, officers, directors, employees, or any of the parties involved in creating, producing, or delivering the Site and the services provided are not liable for any damages whatsoever, including any direct, incidental, consequential, indirect or special damages, or any other losses, costs or expenses of any kind (including legal fees, expert fees, or other disbursements) which may arise, directly or indirectly, regardless of whether or not such liability or damages arise in contract, tort, negligence, equity, statutorily, or otherwise, in any connection with the access to, the use of or browsing of the Site or in connection with any content, information, data, promotions, activities, associated with the Site, or in connection with your downloading of any materials, text, data, images, video or audio from the Site, including but not limited to anything caused by any transmission defects, viruses, bugs, human action or inaction of any computer system, phone line, hardware, software or program malfunctions, or any other errors, failures or delays in computer transmissions or network connections.
16. NO WARRANTY ON CONTENTS, INFORMATION AND MATERIALS
Although the specifications, features, illustrations, equipment and other information contained in the Site are based upon reasonably current information, and while TBS make reasonable efforts to ensure that the material on the Site is correct, accuracy cannot be guaranteed and TBS make no warranties or representations as to its accuracy.
TBS may rely upon others to provide the information that is included in the Site without any direct or independent authentication, verification, assessment, and validation by whatsoever. All users of the Site shall be solely and exclusively responsible to authenticate, verify, assess and validate all information that is included on the Site. The information included in the Site does not constitute, and shall not be considered, the advice, recommendation, or endorsement of TBS.
UNLESS OTHERWISE AGREED TO IN WRITING BY THE BEER STORE, THE INFORMATION, CONTENTS OF THE SITE IS PROVIDED ON AN “AS IS” BASIS ONLY, AND IS FOR CONSUMER PRIVATE AND NON-COMMERCIAL END USE ONLY, AND ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AUTHENTICITY, VALIDITY OR NON-INFRINGEMENT, ARE COMPLETELY DENIED AND DISCLAIMED, EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID BY A COURT OF COMPETENT JURISDICTION. EXCEPT AS OTHERWISE EXPRESSLY AGREED, THE BEER STORE MAKES, NO REPRESENTATIONS, WARRANTIES, COVENANTS OR GUARANTEES AS TO THE QUALITY, AUTHENTICITY, VALIDITY, SUITABILITY, TRUTH, ACCURACY OR COMPLETENESS OF ANY OF THE INFORMATION AND CONTENTS OF THE SITE.
17. COPYRIGHT BELONGS TO THE BEER STORE
TBS are the owners of copyright of the Site and other intellectual property related to the Site. No portion of the Site, including but not limited to the content, information, text, images, audio or video, may be used in any manner, or for any purpose, without TBS’s prior written permission, except if indicated herein. Without in any way waiving any of the foregoing rights, you may download one copy of the material on the Site for your personal, non-commercial home use only, provided you do not delete, obstruct or change any copyright, trademark or other proprietary notices. Modification, repostment or use of the material on the Site in any other manner whatsoever and for any other purpose violates TBS’ legal rights.
18. INTERNET NOT A SECURE MEDIUM
The Internet is not a secure medium, and neither the privacy of your communications, nor visits to the Site, can be guaranteed. The nature of Internet communications means that your communications may be susceptible to data corruption, unauthorized access, interception and delays. The Site may include incomplete information, inaccuracies or typographical errors. TBS and any other persons involved in the management of the Site, may make changes in the information and content included in the Site at any time without notice. TBS shall not be responsible for any detrimental reliance you may place on the Site or its contents. Except as otherwise provided herein, by entering and using the Site you acknowledge and agree that any communication or material you transmit to the Site, in any manner and for any reason, will not be treated as confidential or proprietary. Furthermore, you acknowledge and agree that any communications, information, ideas, concepts, techniques, procedures, methods, systems, designs, plans, charts, or other materials you transmit to the Site may be used by TBS anywhere, anytime and for any reason whatsoever.
19. UNLAWFUL BEHAVIOUR
Do not use the Site to communicate to others, to post on the Site, or otherwise transmit to the Site, any materials, information, or communication that either causes any harm to any person or that is illegal or otherwise unlawful, including without limitation any hateful harassing, pornographic, obscene, profane, defamatory, libelous, threatening materials which constitutes or may encourage conduct that would be considered a criminal offense, give rise to civil liability, promote the excessive, irresponsible or underage consumption of alcohol, or otherwise violate any law or regulation. TBS and all parties involved in creating, producing or delivering the Site and its services, assume no responsibility or liability which may arise from the content thereof, including but not limited to claims for any of the above noted matters. If the Site contains bulletin boards, chat rooms, or other message or communications facilities, e-mail, (collectively, “Forums”), you agree to use the Forums only to send and receive messages and material that shall not, in any manner or to any extent, do any of the following:
commit any criminal or quasi-criminal offence, including without limitation, any pornography, hate, assault, or economic crime whatsoever;
defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information;
infringe, contravene, breach or otherwise interfere with or harm the rights of any other person, including without limitation, any contractual, personality, confidentiality, privacy, moral, statutory, common law or intellectual property;
upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer;
delete any author attributions, trademarks, trade names, logos, legal notices or proprietary designations or labels in any file that is uploaded;
falsify the origin or source of software, information or other material contained in a file that is uploaded;
advertise or offer to sell any goods or services, or conduct or forward any surveys, contests, or chain letters; and
download any file posted by another user of a Forum that you know, or reasonably should know, cannot be legally distributed in such manner.
You acknowledge and agree that all Forums are public and not private communications. Further, you acknowledge that chats, postings, conferences, and other communications by other users are not monitored, screened, sanctioned or endorsed by TBS and such communications shall not be considered reviewed, screened, or approved by TBS. TBS reserves the right for any reason to remove at any time without notice any contents of the Forums received from users, including without limitation bulletin board postings. TBS reserves the right to deny, in its sole and absolute discretion, any user access to this Site or any portion, including Forums, thereof without notice.
20. FRAUD PREVENTION
TBS may monitor Program activity to prevent fraud, abuse or misuse. Without limiting other remedies available to it under Applicable Law, TBS may:
hold payments pending investigation;
reject Bags;
adjust monetary balances
suspend or terminate Accounts;
report suspected unlawful conduct to authorities.
For the avoidance of doubt, Fraudulent activity may include but not be limited to:
submission of ineligible containers;
misrepresentation of contents;
use of stolen Accounts;
submission of stolen containers;
tampering with labels, barcodes, or containers;
attempts to manipulate processing results.
21. HYPERLINKS & THIRD-PARTY WEBSITES
Although the Site may be linked to other websites, TBS are not, directly or indirectly, implying any approval, association, sponsorship, endorsement or affiliation with the linked website, unless specifically stated therein. By entering the Site, you acknowledge and agree that TBS have not reviewed all websites linked to the Site and is not responsible for the content of any off-website pages or any other website linked to the Site. Further, TBS is not liable for any loss or damage that may arise from your use of hyperlinks and/or visiting third-party websites. Your linking to any other off-website pages or other websites is at your own discretion and risk. We encourage you to read the terms and conditions of any website you visit.
22. APPLICABLE LAW
By entering the Site, you acknowledge and agree that the Site, including contests (if applicable) and any goods and services offered on the Site, and these contractual Terms, shall be construed and evaluated according to the laws of the Province of Ontario, Canada. You hereby agree and confirm that your use of the Site and all of the communications, transmissions and transactions associated with the Site shall have occurred in the Province of Ontario, Canada and that you submit to the exclusive jurisdiction of the courts of the Province of Ontario, as the proper and most convenient forum concerning the Site. If you use the Site from another jurisdiction, you are responsible for compliance with any and all applicable local laws.
23. LANGUAGE
English shall be the language of the Site, and all transactions occurring in connection with the Site, and the parties waive any right to use and rely upon any other language, or translations. Il est de la volonté express des parties que le présent Sites et tous les affairs qui s’y rapportent soient rédigés en langue anglaise, exception faite des documents pour lesquels la loi exige l’usage exclusif du français.
24. THE BEER STORE ACCESS CONTROL
We shall have the right, at all times, to prevent, intercept, prohibit or otherwise restrict, your access to and/or use of the Site, including Forums , if TBS determine, in their sole and absolute discretion, that you have not (or TBS have a reasonable basis to believe or expect that you may not) fully complied with all of the provisions set out in this contract.
CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE SITE, OR UNDERMINE THE LEGITIMATE OPERATION OF A GAME AND/OR CONTEST (IF APPLICABLE) IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SITE PROVIDER RESERVEs THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
25. EXCLUSIONS AND LIMITATIONS OF LIABILITY
TBS shall not be responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Site or by any technical or human error which may occur in the processing of submissions in the Site. TBS and its partners and agents assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries.
Unless otherwise provided for in these Terms, TBS shall not be responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or members on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to members or to any other person’s computer related to or resulting from using services or downloading materials in the Site. If, for any reason, the Site are not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of TBS and its agents which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Site and the services offered through the Site, TBS reserves the right to cancel, terminate, modify or suspend the services or Site indefinitely.
You agree to indemnify, defend, and hold harmless TBS and its agents and partners, and their respective parents, subsidiaries, directors, sponsors, officers, consultants, agents, and employees from and against any and all claims, demands, actions, causes of action, damages, losses, liabilities, judgements, penalties, fines, costs, and expenses, including reasonable legal fees and disbursements, arising out of or relating to: (i) your breach of these Terms; (ii) your violation of any Applicable Law, or third-party right; (iii) your submission of prohibited, fraudulent, contaminated, stolen, or ineligible containers; (iv) your negligent, reckless, fraudulent, or intentional misconduct; (v) any claim that information, content, materials, or communications submitted by you infringe, misappropriate, or otherwise violate the intellectual property, privacy, publicity, confidentiality, or other rights of any third party; (vi) any third-party claim alleging obscenity, defamation, libel, slander, invasion of privacy, or infringement of intellectual property rights arising directly or indirectly from your actions, submissions, communications, or use of the Site or Program; and (vii) any use of your Account by you or any person acting with your authorization or access credentials.
26. ACCESS AND USE OF THE DROP AND GO WEBSITE
The Site is available through various internet browsing applications. Features of the Site include: viewing existing deposit refund balances, Account information, Beer Store Drop and Go locations, and container count information.
By creating an Account and using the Site and associated services, provided by TBS, you consent to the Terms stated herein as further described above and to its future updates and upgrades. You can withdraw your consent at any time by deleting your Account. To request removal or disabling of your Account in the event you are unable to through the Site, please contact The Beer Store at:

YOU ACKNOWLEDGE, UNDERSTAND AND AGREE that the Site (including any updates or upgrades) may (i) cause your device to automatically communicate with TBS’ servers to deliver the functionality described above and to record usage metrics, (ii) affect Site-related preferences or data stored in your device, and (iii) collect personal information as set out in our Privacy Policy.
27. CREATING AN ACCOUNT
In order to use the Site, you must create an account (“Account” or “Accounts”). Accounts will save your preferences and allow you to process your Eligible Containers through the Site.
You may never use another person’s account for the purposes of processing a deposit refund associated with your empty container returns. When creating your Account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your Account, and you must keep your Account password secure. Although TBS will not be liable for your losses caused by any unauthorized use of your Account, you may be liable for the losses of TBS or others due to such unauthorized use.
28. SOCIAL RESPONSIBILITY
Through our “We ID 25” program, TBS require that our staff ask for ID from anyone who appears to be 25 years old or younger when purchasing alcohol. However, it’s not just minors that we are watching out for – TBS will refuse services to those who are or appear to be intoxicated.
29. PRIVACY AND SECURITY
The privacy and security of your personal information is important to TBS. TBS uses industry-standard security measures, including Secure Sockets Layer (“SSL”) technology to protect personal information transmitted through the Site. SSL technology helps safeguard information by encrypting data transmitted between your device and TBS’s systems, reducing the risk of unauthorized access while information travels across the Internet. While TBS takes reasonable measures to protect personal information, no method of transmission over the Internet or electronic storage is completely secure, certain risks are inherent in using the Internet.
